2. INFORMATION AND CONSENT

The Personal Data Protection Act (hereinafter “PDPA”) and the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, hereinafter “GDPR”) ensure the protection of natural persons with regard to the processing of personal data and the free movement of such data.

Personal data is legally defined as any “information relating to an identified or identifiable natural person (“the data subject”); an identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, electronic identifiers, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person”.

By accepting the present Privacy Policy the user gives their informed, express, free, and unequivocal consent for the personal data provided through the website http://www.tecnimede.com/ to be included in a file under the responsibility of the TECNIMEDE GROUP, the processing of which under the terms of the legislation on personal data protection complies with the appropriate technical and organisational security measures.

The TECNIMEDE GROUP keeps a database with the registration of its clients made up only of the personal data supplied by the owner of the data at the time of registration, which is automatically collected and processed by TECNIMEDE GROUP, the controller of the personal data processing.

Under no circumstances will personal data on racial or ethnic origin, religious or philosophical beliefs, political opinions, trade union membership, data concerning health, genetic or biometric data, or data concerning sexual activity or orientation be requested.

Under no circumstances shall the TECNIMEDE GROUP carry out any of the following activities with the personal data provided through this website without the express prior consent of the data holder:

  • Transfer it to other persons or entities;
  • Transfer it outside the European Economic Area (EEA).


3. PURPOSES OF PROCESSING PERSONAL DATA

The personal data processed through this page will only be used for the following purposes:

  1. Communication and clarification;
  2. Processing of requests for information;
  3. Management of spontaneous applications and recruitment processes.

The TECNIMEDE GROUP guarantees the confidentiality of all data provided. Although the TECNIMEDE GROUP collects and processes data securely and in such a manner as to prevent its loss or manipulation through the use of the most appropriate methods for this purpose, it is important to bear in mind that data collection over open networks allows personal data to circulate without adequate security conditions, running the risk that it may be seen and used by unauthorised third parties.

Failure to provide the data marked as mandatory means that it is impossible to respond to the request of the data subject.

4. SECURITY MEASURES

The TECNIMEDE GROUP declares that it has implemented and will continue to implement security measures of a technical and organisational nature that are necessary to guarantee the security of the personal data provided to it, in order to avoid its unauthorised alteration, loss, processing, and/or access, taking into account the current state of technology, the nature of the data stored, and the risks to which it is exposed.

The TECNIMEDE GROUP guarantees the confidentiality of the data provided through this website. The collection and processing of data is carried out in a secure manner that prevents it from being lost or manipulated.

Personal data is processed with the legally required level of protection to ensure its safekeeping and prevent its unauthorised alteration, loss, processing, or access, taking into account the state of technology. The user is aware and accepts that internet security measures are not totally impregnable.

Whenever accessing personal data the TECNIMEDE GROUP undertakes to:

  • Store such data using legally required security measures of a technical and organisational nature that guarantee its security and prevent unauthorised alteration, loss, processing, or access, in accordance with the state of technology at any given time, the nature of the data, and the possible risks to which it may be exposed;
  • Use data exclusively for purposes that have been previously defined;
  • Ensure that data is only processed by personnel whose involvement is necessary to fulfil the request of the data subject and who shall be bound to confidentiality and secrecy. In the event that information may be disclosed to third parties for the aforementioned purposes, such third parties shall be obliged to keep the information confidential in accordance with the provisions of this document.
     

5. EXERCISE OF RIGHTS

In accordance with the provisions of the PDPA and the GDPR, the users may exercise their rights to information, access, rectification, deletion, limitation, portability, and opposition at any time, by means of a written request addressed to the TECNIMEDE GROUP by the following means:

6. SUPERVISORY AUTHORITY

In legal terms, the data subject has the right to lodge a complaint regarding personal data protection with the competent supervisory authority, the Portuguese National Commission for Data Protection (CNPD) www.cnpd.pt

7. APPLICATION SUBMISSION PRIVACY POLICY

We inform you that we will proceed to the assessment of your application and will contact you in case your profile matches an open position.

The person responsible for processing your application is the Tecnimede Group and may be contacted at the postal address Rua da Tapada Grande, n.º 2, Abrunheira, 2710-089, Sintra.

The Data Protection Officer (DPO) can be contacted through the postal address of the Person Responsible for Treatment or through the email address dpo@tecnimede.com.

The purpose of the processing of the Personal Data provided with the consent of the Candidate is to allow the execution of the application process for the position or area to which he/she is applying or the management process of spontaneous applications.

The basis of lawfulness for the processing of Personal Data provided in the context of the previous point is consent (art. 6, paragraph 1, al. a) of the RGPD), and the candidate has the right to withdraw consent at any time for the purposes described above. However, the withdrawal of consent does not compromise the lawfulness of the processing carried out on the basis of the consent previously given.

The Personal Data of the Candidate to the vacancy for which he/she applied are kept for 5 years, in the case of application to a specific vacancy or for 1 year in the case of a spontaneous application, after which they are deleted or, if it is in the interest of Tecnimede Group, anonymized in such a way that the Candidate is not, or can no longer be identified. The Candidate must submit a new application after this period if he/she wishes to remain on the recruitment files of Tecnimede Group or send in writing (on paper or electronically) his/her consent so that he/she may continue to be on the recruitment file after the mentioned period.

The recipients or categories of recipients of your Personal Data are the Human Resources department and the Administrator, Unit Manager and Team Manager of the function or area for which you are applying.

 As a rule, the Personal Data provided to Tecnimede Group by the Candidate in the context of an application are not transferred to third countries. However, data may be shared within and outside the European Union where required by law or to respond to legal process, to protect lives, to maintain the security of our services, and to protect property rights or Tecnimede Group.

The recruitment process does not involve automated decision making, including profiling.

No comparisons, interconnections or any other way of interrelating the information recorded are carried out.

 By giving information you are giving your informed and unambiguous consent that you consent to the processing of data concerning you in an automated manner.

 We rely on the Candidate, to provide us with accurate and complete information and to proceed to update the data in relation to any change in the information provided.

In compliance with the provisions of the General Data Protection Regulation (GDPR) in Articles 15 et seq., the Candidate enjoys the following rights in relation to Personal Data concerning him/her:

  • Right to information and access to data concerning him/her;
  • Right to rectification of inaccurate, incorrect, out-of-date or incomplete data, without undue delay on the part of the Tecnimede Group;
  • Right to erasure of data, without undue delay on the part of the Tecnimede Group;
  • Right to limitation of processing of data concerning him/her in the event of the application of any of the situations described in art. 18, paragraph 1 of the RGPD;
  • Right to data portability;
  • Right to object to the processing of your personal data if it is not covered by a legitimate cause, contractual or legal obligation provided for in legislation
  • Right not to be subject to automated individual decisions, including profiling;
  • Right to withdraw consent when this is the basis of lawfulness for processing of Personal Data.

Right to be informed in case of a Personal Data breach, i.e. a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, Personal Data transmitted, stored or otherwise processed and when such breach is likely to result in a high risk to the rights and freedoms of Candidates

Right to lodge a complaint with a European Union Supervisory Authority regarding the protection of his Personal Data, whereby Tecnimede Group will cooperate with the Supervisory Authority, providing it with all the information that, in the exercise of its powers, it may request.

The request to exercise the above mentioned rights must be made in writing and presented to Tecnimede Group, which may be contacted through the contact described above.

Consent is required for the further processing of Personal Data for a purpose other than that for which the data has been collected. Before such processing, Tecnimede Group shall provide the Candidate with information on this purpose and any other relevant information.

Tecnimede Group shall only accept applications from candidates who are at least 18 years of age, have completed compulsory education and have the physical and mental capacity appropriate to the position.

Tecnimede Group accepts no liability when, for reasons unknown or unknown to it, error, damage, diffusion or unauthorized access occurs as a result of the electronic transmission of data which may occur between Grupo Tecnimede and the Data Holder.

Tecnimede Group applies appropriate technical and organizational measures to ensure a level of security appropriate to the risk by keeping on file the Personal Data of candidates.

Tecnimede Group has a computer system capable of resisting, with a given level of confidence, accidental events or malicious or illicit actions that compromise the availability, authenticity, integrity and confidentiality of the Personal Data stored or transmitted, as well as the security of the related services offered by or accessible through these networks and systems.
